Court orders Attorney General to give Opuni, Agongo Documents for Trial

A High Court in Accra has ordered the Attorney General’s Department to furnish Dr Stephen Opuni and Siedu Agongo all documents in its possession that will be referenced in their trial within 7 days.

Counsel for the two, relied on Article 19(2) (e)and (g) to fight their case demanding the release of all documents including those it will not rely on in the course of the trial, to inform their defence in the trial of the substantive case.

Dr Stephen Opuni is facing trial for defrauding the state with false pretenses and corruption in the award of contract for the supply of Lithovit Foliar Fertilizer for application by farmers in cocoa for the 2013/2014 cocoa season,

He and businessman Seidu Agongo are facing charges for alleged financial malfeasance in the execution of some contracts at COCOBOD.

According to a copy of the suit, between January 2014 and November 2014 in Accra, the CEO abetted Seidu Agongo and Agricult Ghana Ltd to defraud COCOBOD of over 43 million cedis.

The Supreme Court had earlier ruled that accused persons be furnished with all pre-trial documents, the High Court presided over by Justice Clemence K. Honyenugah said the apex court ruling need no interpretation.

The court said this will enable the accused persons to prepare their defence.

The substantive case has been adjourned to July 4.
