The Office of the Special Prosecutor Bill, 2017 has been laid in Parliament and referred to the Committee on Constitutional, Legal and Parliamentary Affairs for consideration and report.
Pursuant to this and in line with its programme for the consideration of the Bill, the Committee seeks broader consultations and views of citizens and relevant stakeholders involved in combating corruption.
Penplusbytes is thus soliciting for your views on the creation of the office of the Special Prosecutor.
Should the Special Prosecutor only focus on corruption cases?
Should the Special Prosecutor be elected?
Should he/she be appointed through the same process as the EC Chairperson?
Should the Special Prosecutor’s term of office be limited to 3 years as stated in the draft Bill?
Will the Special Prosecutor’s office duplicate the duties of the Attorney General who is constitutionally mandated to prosecute all criminal cases?
Attached is a copy of the Draft Bill for your perusal and subsequent inputs.
