Achimota School Found Negligent in Student’s Death, Ordered to Pay Damages

Achimota School has been held liable for negligence resulting in the death of 15-year-old student Kervin Kofi Moses, who passed away in December 2016 after falling ill while at school.

The judgment, delivered recently, detailed that Kervin visited the school’s clinic complaining of malaria symptoms but was given ibuprofen instead despite his condition worsening. His mother, concerned about his health, repeatedly requested permission from the school’s Housemaster to take him to the hospital, which was declined.

The court found that Achimota School, through its Housemaster, failed in its duty of care towards Kervin, who was under its supervision. Despite pleas from the mother for updates on her son’s health, many of which went unanswered, Kervin’s condition deteriorated until he was finally hospitalized and subsequently passed away at the 37 Military Hospital.

In response to the lawsuit against Achimota School, the Housemaster, and the Attorney General, the court awarded GH¢ 400,000 in general damages and an additional GH¢ 200,000 for negligence leading to Kervin’s death.

This ruling highlights the school’s responsibility to ensure the well-being of its students. It underscores the tragic consequences of negligence in fulfilling this duty.
