Coup plot: Court to rule on application filed by ACP Dr Agordzor’s lawyer today

The Kaneshie District Court, will today, make its position known on an application filed by the lawyer for embattled Assistant Commissioner of Police (ACP) Dr Benjamin Agordzor, in the ongoing trial relating to his involvement in the alleged coup plot, ABC News can report.

The lawyer, Martin Kpebu, is challenging the jurisdiction of the court to hear the case against his client brought before it by the State.

ACP Dr. Benjamin Agordzor has been charged with abetment to commit treason after he was accused of financially aiding the alleged coup plotters and contributing to discussions on a WhatsApp platform formed by the leadership of the coup plotters.

Martin Kpebu argued that the inability of the Court to accept a bail plea because of its limited powers means it doesn’t have the locus to sit on the substantive matter.

“The judge should not handle the case at all because usually from experience the judge will just remand the accused person till the next court sitting and then the defense counsel will be told that he should go to the High Court and all bail; can you imagine?

“So what they do is that every time, we will just come to the court and the judge will say go and lock him in remand and if you want bail, they say don’t come here, go to the High Court.  So we are saying that if the judge cannot grant bail, then the judge also cannot have the power to be locking,” he submitted in an interview with ABC News after the Court appearance on Wednesday.

Dr. Benjamin Agordzor, who has been implicated in the alleged coup plot has been remanded in the custody of the Bureau of National Investigations (BNI).

The Senior police officer, who is expected back in court today, has maintained his innocence and suggested it is an attempt to gag him.
