Destool Chiefs involved in Galamsey and Land Looting?

ALL FIDUCIARIES HAVE A RESPONSIBILITY TO BE TRANSPARENT AND ACCOUNTABLE TO THE PEOPLE.

A CHIEF is one hailing from the appropriate family lineage and bloodline, selected or elected and enstooled or enskinned in accordance with the tradition and customary law.

A THIEF is a person who wrongfully takes anything that does not belong to him or rightfully belongs to others for his personal gain.

Corruption is the abuse of public office for personal gain.

BEFORE YOU SIGN ANY DOCUMENT;

BE SURE IT WILL NOT LAND YOU IN JAIL.

There are consequences for every action especially signing official document purporting to give authorisation to a third party over LAND, SALT, GOLD or any other valuable TRUST PROPERTY being held in trust by the TRUSTEE or FIDUCIARY.

EXECUTIVE INSTRUMENT:

The President has issued several controversial Executive Instruments in respect of Land [Ashanti Lands to the Ashantihene in trust for the Subjects of the GOLDEN STOOL], Forest [Achimota Forest Declassification] and Salt [Ada Songhor Salt to McDan’s Electrochem] attracting protests from the Citizenry and Civil Society Organisations.

OccupyGhana has been silent about the fact that the Ashanti Lands returned to the Original Land Owners through the Asantehene was acquired by the State before the 1992 Constitution came into force.

OccupyGhana has taken a general position that no Land acquired before the 1992 Constitution came into force should be returned to the Original Land Owners because the State needed more land for developmental projects now than ever before.

The Seven Seas Salt Mining Company is currently being sanctioned whiles the government is facilitating McDan to export Ada Songhor Salt.

MINING LICENSE:

The Lands Minister upon the recommendation of agencies has issued various licences which has resulted in abuse manifested by the prevalence of galamsey activities.

Salt like Gold is considered as a Mineral or Natural Resource belonging to the State and not the Chiefs on whose land the Minerals are mined; therefore as TRUSTEE or FIDUCIARY the allocation per Executive Instrument must be scrutinised and if irregular nullified.

President Akufo-Addo went to meet the Asantehene at Manhyia in the company of the Ashanti Regional Chairman of the NPP [Chairman Wuntumi] whose Akonta Mining Company has being found to be involved in Galamsey activities in the forest reserve and destroying rivers and water bodies…

President Akufo-Addo has by this single act of indiscretion proved that he is not serious about fighting Galamsey.

President Akufo-Addo has not ordered the arrest of the Okyehene’s Galamsey Vigilante group that went went on a shooting spree in the streets of Akyem Abuakwa.

FRAUDULENT LAND DOCUMENTS:

The Lands Commission and various Chiefs including self-styled Thief-Chiefs have signed various fraudulent documents purporting to be leasing or extending existing leases of Lands to unsuspecting third parties.

The arbitrary, inefficient and unplanned use of Lands in Ghana is a threat to the overall development of Ghana.

ACT 1036:
The new Land Law seeks to sanitise the land administration regime by harmonising all laws relating to land in Ghana, ensure Transparency and Accountability in all Land Transactions and punish all illegal activities in such transactions with stiff fines and long prison sentences.

ALL THIEVES, CORRUPT GOVERNMENT OFFICIALS AND CHIEFS found to be culpable are liable under ACT 1036 to hefty fines and prison sentences.

CASE STUDY:
LA has the choisiest and most expensive prime lands in Ghana and therefore has been at the centre of most of the Land Looting and fraudulent allocation of State Lands to private persons contrary to the 1992 Constitution of Ghana.

The La Mantse Nii Kpobi Kpobi Tsuru Tsuru II submitted in 2017 and 2018 two (2) Petitions to President Akufo Addo on the Looting of La Lands and the clandestine annexation of La Lands by the Military but was ignored by the President; leading to the La Mantse serving notice of a Court action against the State on the Looting of La Lands.

The actions initiated by the La Mantse Nii Kpobi Tettey Tsuru II triggered some Citizens of La to submit an Article 146 Petition for the removal of then Chief Justice Sophia Akuffo who was complicit in the fraudulent allocation of La Lands, ahead of any such court case since she will be empanelled judges for the case(s) that La will be pursuing.

FACT:
Chief Justice Sophia Akuffo paid GHc7000 for prime Cantonments State Land fraudulently allocated to her and escaped removal from office as Chief Justice because President Akufo Addo in breach of the Constitution, refused to act on the Article 146 Petition brought before him, committing a HIGH CRIME for which he can be removed from office as President.

Sampson Lardi Anyenini and his OccupyGhana friends who said that the President was only a conveyor belt in such Article 146 Petition cases and had no choice but to act immediately he received an Article 146 Petition, were aware of the Justice Sophia Akuffo Article 146 Petition but pretended to be unaware to save Justice Sophia Akuffo and President Akufo-Addo from any liability.

OccupyGhana is aware of another Article 146 Petition for the removal of Jean Adukwei Mensa as Chairperson of the Electoral Commission which again President Akufo Addo has refused to act on since 21st January, 2021 in breach of the Constitution.

Chief Justice Georgina Theodora Woode was also fraudulently allocated prime State Land at Airport but she relinquished the land, when an Article 146 Petition for her removal was submitted to President John Evans Atta Mills, that Land was subsequently used to build the Foreign Affairs Head Office Complex.

President Akufo-Addo, the Lands Minister, Attorney General and the Special Prosecutor are in possession of a copy of the long list of hundreds of other high profile personalities who were fraudulently allocated prime State Land attached to the Justice Sophia Akuffo Article 146 Petition; which fraudulent allocations must be reversed and Lands retrieved to the State or returned to the La Stool.

THE STATE CAN COMPULSORILY ACQUIRE ANY LAND anywhere in the public interest for a particular stated public purpose for a specified period and pay appropriate compensation to the Original Land Owners.

However, whiles the Constitution clearly states in Article 20 (5)(6) how such Lands must be returned to the Original Land Owners who have the right of first refusal, when the purpose is changed;

The Supreme Court erred in the La Mantse Nii Kpobi Tettey Tsuru II vs Attorney General judgement which is considered by various legal luminaries as a grave travesty of Justice by equating “public purpose” with “public interest” thus opening the floodgates for the Land Looting.

CANTONMENTS CIVIL AVIATION LANDGRAB:
Following the earlier 2007 illegal annexation of portions of the Cantonments Civil Aviation Land for the Ghana@50 AU Village Mansions under President Kufuor;

The remainder of the Cantonments Land acquired by the State for Civil Aviation purposes is being stolen by faceless persons under President Akufo-Addo.

The former Lands Minister, Kwaku Asoma-Cheremeh signed a FRAUDULENT MoU purporting an illegal takeover of the Cantonments Civil Aviation Land which was resisted by the staff of the Civil Aviation Authority and citizens of La leading to the suspension of the alleged takeover by the Lands Minister Samuel Abu Jinapor who commissioned an investigation but till date he has refused to make the report public.

In the absence of any Official Report on the Cantonments Civil Aviation Land Looting, there is illegal construction work ongoing at the Cantonments Civil Aviation site while the Lands Minister and Lands Commission look on sheepishly.

Samuel Abu Jinapor claimed to have ordered a STOP WORK NOTICE to developers on the Cantonments Civil Aviation Land which has been ignored without any consequences.

Samuel Abu Jinapor promised on the floor of Parliament to make public by June 2021, the Report on the Kpletso Lands clandestinely being annexed by the Military but has since failed…

Samuel Abu Jinapor claimed that he wrote to the Defence Minister to stop the Military from further construction work at the disputed Kpletso land but that also had been ignored by the Military who are continuing with their illegal construction work.

The Lands Minister must either be effective or resign, he must deliver on his mandate or be sacked or be removed.

The same ineffectiveness of the Lands Minister has led to the Galamsey crisis and aggravated the Land Looting which is festering everywhere.

Ghanaians are resolved to be Citizens and not Spectators.

The Lands Ministry as confirmed by the Executive Secretary of the Lands Commission, has signed an illegal agreement with the notorious Landguard Clemence Gyato and Anyok Holdings to reclaim encroached State Lands and be paid with portions of the State Lands which is shared with some government officials.

Samuel Abu Jinapor has been lamenting on national television that the people people are revered in our society go go on weekends looking for State Lands and Bungalows with little or no activity then come to his office to pressure him to allocate allocate prime lands to them.

THE LANDS MINISTER MUST NAME THEM OR RESIGN.

Ghanaians will no longer entertain the lamentations without appropriate action…
