Chief Justice Gertrude Sackey Torkornoo has dismissed a petition seeking the removal of Kissi Agyebeng from his position as Special Prosecutor, citing insufficient grounds and evidence.
The petition, submitted by Martin Amidu, former Special Prosecutor, alleged serious misconduct, including procurement breaches and abuses of power involving judicial officials. Amidu forwarded his concerns to President Akufo-Addo, who referred the matter to Justice Torkornoo for review on May 6, 2024.
After careful examination, the Chief Justice concluded that the petition did not meet the legal threshold required to establish a prima facie case for Agyebeng’s removal. Sources close to the matter revealed that the petition lacked substantial factual and legal basis to warrant further investigation.
In a statement addressing the dismissal, Chief Justice Torkornoo highlighted that Martin Amidu’s allegations failed to provide sufficient evidence to support Kissi Agyebeng’s claims of misconduct. According to the Chief Justice, this decision aligns with Section 15(3) of the Office of the Special Prosecutor Act, 2017, which stipulates the criteria for evaluating such petitions.
“I have today received confirmation from the Presidency that the Chief Justice has reviewed the petition and determined that it does not establish a prima facie case for the removal of the Special Prosecutor,” said Martin Amidu in response to the decision.
The dismissal underscores the rigorous standards required for initiating disciplinary actions against public officials, emphasizing the importance of substantiated claims in upholding accountability within government institutions.
