Member of Parliament for Assin North James Gyakye Quayson says he’s unperturbed by the delay in the ruling of his submission of no case after the court gave another adjournment in the matter.

The High Court was set to decide on whether the prosecution had made a case for the legislator to open his defence or be discharged.

Gyakye Quayson is facing charges of deceit of public officer, forgery of passport or travel certificates, knowingly making a false statutory dec­laration, and perjury and false declaration for office.

He has pleaded not guilty and remains on bail.

However, when the case was called on Thursday, March 27 Justice Maame Ekue Yanzuh stood down the hearing after noting that the prosecution had filed additional disclosures on Wednesday, March 26.

 

She asked lawyers of Assin North MP if they had been served and they responded in the affirmative.

Lead counsel for the legislator, Tsatsu Tsikata prayed the court to proceed since the document was of no effect.

“What the prosecution purported to have found yesterday should not delay your ruling on our submission of no case. We submit that it’s an abuse of court for them to claim to be providing further disclosures pursuant to the grant of an application made by the accused person. Your orders were made in December 2024 for these further disclosures.

“They didn’t comply but asked for more time. They were given more time but they still didn’t comply. Your ladyship then gave orders for written submissions to be filed.

“We complied and only filed on the 27th February instead of 26th because certain court notes which we had requested only became available in the afternoon of 26th,” Tsatsu posited.

“The prosecution did not oblige. Even though on the 3rd of March when we came before you a further opportunity was provided for them to file they still did not do so. And the disclosures were not filed.

“You set the 27th of March to deliver your ruling. At 3pm on 26th they filed further disclosures.

“That is an abuse of court processes if there was one. We therefore respectfully submit that your ladyship take note of this serious failure to comply with your orders,” he added.

The case has been adjourned to April 9 for ruling on the submission of no case.
