Pokuase: Allodial Land Owners injunct Estate Developers, 3 Government Para Staters

Our checks have shown that all the defendants have been served with this writ of summons, but no date has been fixed yet for the court appearance.

As the tussle, hustle, struggle and scramble for the “Agric Land” at Pokuase, a suburb of Accra between Allodial Land owners and Estate Developer linger on, the former has taken a leap forward to establish its authority of ownership on the disputed land.

Subsequently they have slapped the later with an injunction order restraining them (Estate Developers) from entering the space, let alone, carrying out their intended businesses. The two staters are the Land Commission and the Ga North Municipal Assembly.

The Writ of summon with suit No. No. LD/0313/2023 and dated April 20, 2023 emanates from High Court of Justice, Accra.

In the said writ, Grace Darkwa Dodoo, head of the Dodoo Koblah Family, in conjugation with Munini Darko Dodoo and Micheal Nii Anu Dodoo …………………….. is seeking the respondents

  1. Frank Paul Ventures
  2. Devtraco Limited Accra
  3. State Housing Company Limited

The Land Commission HQ Cantonments Accra. Others are Frank Tackie Consult, Accra and Ga North Municipal Assembly (Defendants)

In point 5 of their statement of claim, the Plaintiffs are seeking an order for interlocutory/perpetual injunction as the defendants, their agents, assign, relatives, successors, and representatives from ever laying any claim or possession or ever coming to any portion of the Plaintiffs land and, or, doing or dealing with some or as to amount to laying claim to, or disturbing or denying the plaintiffs full and continued peaceful enjoyment of their property.

The unit, which also described the defendants as trespassers on the plaintiffs land, is seeking further to command the defendants to cause an appearance in court within 8 days of service of this writ on them.

“And take notice that in default of your so doing Frank Paul Ventures, Devtarco plus Limited, Land Commission Headquarters Cantonments, Frank Tackie Consult, Accra, Ga North Municipality Assembly, Amamoley, Judgment Maybe given in your absence without further notice to you”, the writ warned.
